SUBJECT:  AMENDED RULES AND REGULATIONS – April 2024.

NEW:  AMENDMENT'S THE INCLUSION OF PENALTY ASSESSMENTS FOR VIOLATIONS AND CHANGES TO POLICIES. 

Dear Homeowner and Resident:

The Board of Directors of the Tustin Village Homeowner’s Association has compiled this booklet of Rules and Regulations for the Community, which now includes a listing of penalty assessments that may be levied for violations of the Rules and Regulations.  Other updates have been made to this document. 

 

This is your home, and these Rules and Regulations are intended to make it an enjoyable and safe place to live.   They are to encourage and preserve the peace, health, safety, welfare, property and convenience of the residents of Tustin Village II.


Mutual respect will minimize the need for reminders or enforcement.  However, since there is no resident manager on site, we are each individually responsible for their enforcement together with the cooperation of the Security Officer and the Board of Directors.


If a reminder to a neighbor becomes necessary, approach the situation in the same considerate and courteous manner that you would like to be approached.   In the event that you have problems that cannot be solved – DO NOT CALL A MEMBER OF THE BOARD OF DIRECTORS -  PUT YOUR COMPLAINT IN WRITING AND FORWARD IT TO THE MANAGEMENT COMPANY.  IF NECESSARY, CALL THE MANAGEMENT COMPANY DIRECTLY.


The Board of Directors are also homeowners and they do not receive any compensation for their services but do devote many hours to the administration of the Association, therefore, it is requested that you use the services of the management company. 

PLEASE:  Take the time to read the booklet and acquaint yourselves and all residents of your unit with the information provided.  By doing so, you and your family and friends will be aware of the Rules and Regulations and also the Violation of same and the possibility of a penalty assessment being levied for non-compliance. 

These rules are not going to be perfect but have been made for all Homeowners and Residents to ensure that you will be residing in a community that cares and wants to make living conditions as pleasant as possible for everyone.

RULES AND REGULATIONS


REVISED APRIL 2024


AUTHORITY:

By the authority established in Article IX, Section 6 of the Declaration of Covenants Conditions and

Restrictions for Tustin Village Il, “The Board of Directors shall have the power, duty and obligation to control the use of the Common Area” and Article Vll, Section 2(b) of the By-Laws, "Adopt Rules and Regulations”.

Original version of Rules and Regulations – 1978.  Revised 1992, 1993, 1995, 1997, 1998, 1999, 2000, 2019 and this revision 2024.

ENFORCEMENT

The Board of   Directors of Tustin Village II Homeowners Association, in accordance with the governing documents Covenants, Conditions and Restrictions and the By-Laws of the Association have authority to strictly enforce any and all of the following Rules and Regulations.  The Board of Directors authorizes the Security Officer to do all requested enforcement of these Rules and Regulations and report them to the Board. 

OWNERSHIP

1. Each unit shall be used as a private dwelling and for no other purpose such as a professional, commercial business, retail or industrial operation. 

2. Garages, carports and patio areas are common areas with exclusive use by owner/residents.  Maintenance of the garages and carports areas is the responsibility of the owner/resident.  Patio Areas:  No objects are permitted to be above the fence line.   Garages may not be converted to living quarters or any other conversions, with parking of cars the only permissible use.  

RULES AND REGULATIONS

COMMON AREA

ACTIVITES


1. NO Bicycles, skateboards, razors, roller skates or big wheels type carts on any walkway or common area green belt.

2. NO Hard balls or objects deemed dangerous in the common area green belt.

No playing on common area green belt during reseeding time. The Board of Directors reserves the right to restrict the type of sports on common area green belt.

3. NO Climbing of trees, playing in bushes and shrubs and flower beds or the removal of flowers or

removal or plants from landscape. Responsible parties will be held financially responsible for repair costs or replacement costs. 

4. NO Playing in the streets or fire lanes, vehicles have the right of way. 

5.   NO Vandalism of the sprinkler and watering system in the common area.  Responsible parties will be financially responsible for repairs and replacement costs.

6. NO Activities that may cause injury to persons or damage to property. 

7. NO Loud pIay of stereos, TVs, radios, bands or any other loud disturbances inside or outside of the units including music from vehicles in the common area. 

8. NO Use of improper language.

9. NO Garage, Yard or Rummage Sales on Tustin Village II Property.

10. CURFEW HOURS FOR CHILDREN IN THE COMMON AREA IS 10:00 P.M.

THE PLAYGROUND AREA IS CLOSED AT DUSK UNLESS PARENTS ARE PRESENT.

Shall be enforced by the Security 0fficer. Violators Will be reported to their parents and if necessary, further action will be taken by the Tustin Village II HOA. 

  The Security Officer has the authority to impound items and hold them for redemption by the parents. 

NUISANCE

⦁ Any loud disturbance such as stereos, radios, musical instruments, live bands, party or personal noise emitting from a unit is not permitted. (Article VI, Section 2).  Any such violation will be strictly enforced by the Security Officer and if necessary, with the support of the Tustin Police Department.

⦁ Any vehicles, boats, trailers etc., which are parked illegally shall be cited by the Security Service and if the violation is not corrected, the Security Officer has the authority to have them towed at the owner’s expense. 


PETS

⦁ Each unit is permitted three (3) domestic animals per City of Tustin provided they are kept inside the unit or enclosed patio. 

⦁ Dogs must be on a leash and under control by the responsible person ALL times when in the common areas of the complex.  Owners are required to clean up after their pets. 

⦁ Dogs running loose in the common area will be reported to the Orange County Animal Control for capture and confinement.

Pet Rules are governed by the Tustin Village II HOA and Orange County Ordinance. 



RULES AND REGULATIONS

COMMON AREA

ARCHITECTURAL

⦁ Any proposed changes to the exterior of the unit, garages, carports including any installations of patio covers, detached storage sheds, satellite dishes etc., must have prior written approval of the Architectural Committee and the Board of Directors.   Any damage to buildings or roofs by any illegal installation is the responsibility of the unit Owner.  Plans must be submitted detailing any proposed alterations or installations.  Detached Storage Sheds shall be the same height as the existing fence and shall not be any larger than 6 ft. x 6 ft.   ALL PLANS MUST BE APPROVED BY THE ARCHITECTURAL COMMITTEE AND CONCURRED BY THE BOARD OF DIRECTORS AND ANY CITY PERMITS OBTAINED PRIOR TO THE COMMENCEMENT OF ANY CONSTRUCTION.

⦁ NO TV or radio antennas or other similar receiving devices may only be installed on roof fascia, not the roof tops and shingle areas.  Any damage or water leakage to buildings or roofs by such illegal installation is the responsibility of the owner. 

⦁ NO Advertising signs to be placed in the common area of the complex.  Requests can be submitted to the Architectural Committee for review.  Real Estate/For Sale signs may be placed inside the front window of the units. 

4. Each unit is required to have standard window dressing including curtains, drapes, blinds etc., and must be kept neat and in good condition when viewed from the exterior of the unit.   Screens are required at all times on openable windows. New windows require prior approval from the property manager.


⦁ Front Doors:  Must be wood in appearance and may be made of steel, wood or fiberglass.   Paint color must match the existing paint scheme.  All front doors must be maintained- painted kept clean and neat by residents.  In the interim of painting of the entire complex, the owner/resident is responsible for the maintenance.   For approved color specifications, please contact the Property Manager.  

⦁ Screen/Security Doors:  No screen/security door may be installed without the signing of a screen door agreement that can be obtained from the management company.  All Screen/security doors must be maintained in good condition and be Black Wrought Iron type.   Per the agreement, failure to maintain the door could result in the Board of Directors having the door removed at the owner’s expense. 

TRASH AND TRASH BIN AREAS

⦁ All trash must be placed in the trash bins provided.   Garbage and trash must be in Plastic Bags and closed before being deposited in the bins.  Large articles, cartons, boxes etc. must be broken and flattened. 

2. NO      Furniture, mattresses, box springs, carpet, appliance, surplus lumber, concrete blocks, building materials, bricks, oils and toxic substances, paint, or any large objects may be placed in the bins or the trash bin areas.  The owner/resident is responsible for disposing of these items off-site or the owner/resident may call the Property Manager for directions. 

3. All residents are responsible for keeping the trash -bin areas clean and neat.  DO NOT DEPOSIT TRASH AROUND THE TRASH BIN AREA OR BLOCK THE ACCESS BY THE PICKUP COMPANY.   TRASH MUST BE MUST BE IN THE TRASH BIN.  The Trash Company will not remove any items outside of the bin.   Do not put garbage or building materials into the designated Recycle bins.   

4.  NO Papers, trash, furniture, toys, or debris is permitted to accumulate or be stored around any section of the unit front, back sides or the carport and garage areas or they will be removed without notice.  Patios must be kept clean and neat and free of trash and debris. 

5.   NO   Flammable materials and toxic substances may be stored on the patios or in the garages. This is mandated by the insurance company and the Fire Department as well as these Rules and Regulations. 

THIS IS YOUR HOME – TAKE PRIDE IN THE APPEARANCE AND THE APPEARANCE OF THE COMPLEX.

POOLS

The Association does not provide a Lifeguard. Residents must assume responsibility for themselves, their children and guests.

1. NO GLASS containers in pool area. Food and beverages must be in unbreakable containers.

ALCOHOLIC beverages are not permitted in pool area. 

2. NO PETS or ANIMALS are permitted in the pool area per California Health Code

3. NO Running, pushing, or horseplay or excessive splashing in the pools or deck areas.

NO Ball playing in the pool areas.

4. NO Excessive noise, loud radios or stereos.

5. NO Scuba Gear, Tanks, Equipment Training of clients in pools. No Styrofoam floats

6. NO Hairpins clips in the pools or pool areas. Causes rust and can clog pool equipment.

7. NO Climbing over the fence to gain admittance to pools.  Must have key and the gates must be kept dosed and locked at all times.  DO NOT PROP OPEN THE GATES.

Vandalism of any of the Association Pool Equipment in the pool area OR the restrooms is a violation of HOA policy. 

Violators will be financially responsible for all damages and the Board of Directors does reserve the right to close the pools in the event of vandalism.   The use of pool emergency and lifesaving tools as play tools is a violation of HOA policy. 



POOL USE Restrictions:


a.  Appropriate swimwear must be used.  No blue jeans or denim shorts in the pools.   

b.  Children in diapers must wear waterproof pants.   Any accidental mess in the pool or pool area must be 

      immediately removed by the responsible adult. 

c.   Any child thirteen (14) years and younger must be- accompanied by a responsible adult resident of 

      18 years or older. 

d.   Any resident under the age of 18 attending the pool must have an adult accompany their guests.  

e.   No more than FOUR (4) GUESTS are permitted at the pools per unit.  Guests must be accompanied 

      by a resident Adult at all times

f.   NO pool parties are permitted. 

      USE OF THE TUSTIN VILLAGE II POOLS AND POOL AREA IS RESTRICTED TO RESIDENTS ONLY AND THEIR 

      GUESTS.  RESTROOMS ARE PROVIDED AND MUST BE KEPT CLEAN. 

      DURING THE MONTHS WHEN THE POOLS ARE OPEN COURTESY MUST BE EXERCISED BY ALL RESIDENTS 

      REGARDING THE USE OF THE POOLS AND THE POOL HOURS.   

ALL THE ABOVE RULES WILL BE STRICTLY ENFORCED BY THE SECURITY OFFICER.  VIOLATORS WILL BE WARNED AND IF THEY DO NOT COMPLY, WILL BE REQUESTED TO LEAVE OR WILL BE ESCORTED BY THE SECURITY SERVICE. ALL VIOLATIONS WILL BE REPORTED TO THE HOA BOARD, AND MAY RESULT IN RESTRICTION OF POOL USE TO THE OFFENDING UNIT.    

NOTE: POOLS WILL BE CLOSED,  CHAINED AND PADLOCKED DURING THE WINTER MONTHS.


PARKING     rev 4/2024

⦁ Vehicles must be parked in garage(s) or carport(s) provided for each unit. All vehicles must be operable and motorized and kept in a clean and neat condition. A MAXIMUM of THREE (3) vehicles per unit is permitted in the complex. Any additional vehicles must be parked outside of the complex, on the street. 

⦁ Parking permits will be issued based upon the number of parking spaces assigned to you. If you have three assigned parking spaces, you will not be eligible for any parking permits. If you have two assigned spaces, you will be eligible for one parking permit. If you have one assigned parking space, you will be eligible for two parking permits.

⦁ Assigned spaces include garages, carports, any assigned uncovered spaces and/or spaces behind your carport. They include any spaces intended for your exclusive use.

⦁ Parking permits are not transferrable to other vehicles. If a vehicle’s parking permit number does not match the license plate on the parking permit registration list, the vehicle will be towed at the owner’s expense. 

⦁ Vehicles with valid permits can park in the common area for up to 72 hours.

⦁ Only 1 permitted vehicle from a unit may be parked at any time in the circular parking area in front of the Clubhouse.

⦁ Any vehicles that are illegally parked on the streets of Montego Way and Townhouse Drive or in the Clubhouse circle common area parking space shall be cited. Failure to remove vehicle after ticketing shall result in Security obtaining authority to tow the vehicle at the owner’s expense. 

⦁ NO PARKING in the RED CURB areas or BEHIND the GARAGES.

⦁ NO PARKING in the FIRE AND EMERGENCY VEHICLES ACCESS ROADS. The access roads are driving areas of Townhouse Drive and Montego Way and any access lanes to the garages and carports.

⦁ NO PARKING of BOATS, NON-MOTORIZED VEHICLES, TRAILERS, MOTOR HOMES, COMMERCIAL VEHICLES is permitted in the complex either in the common area parking spaces or assigned garages or carports. (Section H, Article VI)

⦁ Any illegally parked vehicle or non-permitted vehicle, any per sections 3-4-5-6 and 10 MAY BE TOWED WITHOUT NOTICE. Security will coordinate with a board member prior to towing. All vehicles must be parked legally on the streets and in the marked spaces in front of the clubhouse. Parking is on a first-come basis. 

⦁ It is the responsibility of the residents to see that their guests do not violate any of the parking rules and regulations. Residents may allow guests to park in their garage or carport areas for a maximum of one week.

⦁ No parking permits will be issued to vehicles with expired registration/DMV tags, and the vehicle’s registration must match the resident’s address.

⦁ No parking permits will be issued to motorcycles, motor homes, non- motorized vehicles or commercial vehicles. 

⦁ No unregistered/expired registration vehicles are allowed in the Common Area parking areas. 

⦁ Exceptions to these rules will be made for service professionals like plumbers, electricians, maintenance vehicles and emergency vehicles.


GARAGES AND CARPORTS

1.   Residents and unit owners are responsible for maintaining the garage and carport in a clean and neat condition at all times.  All oil, fluids, and debris must be cleaned up on a regular basis.  Maintenance of these areas is not the Association responsibility.   OILS, FLUIDS AND HAZARDOUS WASTE MUST BE DISPOSED OF IN ACCORDANCE WITH CITY AND STATE REGULATIONS, NOT TRASH BINS.

2.  NO STORAGE of any items is permitted in or around CARPORTS. Storage in garages must not prevent the resident from parking vehicles in the garage interior. This includes but is not limited to non-motorized vehicles or inoperable vehicles. NO conversion of garages to living quarters or any other changes are permitted.  Garages and carports are for vehicles only.

3.   NO  major mechanical vehicle repairs, rebuilding of engines or working on non-resident vehicles is permitted in garages and carports.  This includes motorcycles and any type of vehicles.

4.    NO unauthorized persons are permitted on the roofs of carports, garages and units.  Any damage to the roofs by such an unauthorized person shall be charged to the offending parties and may void roof warranty. (Article VI Section 2)

5.  Garage Doors must be kept closed when garages are left unattended. Repair, Maintenance and

Replacement of garage doors is the responsibility of the unit owner including painting.



RECREATION ROOM CLUBHOUSE

Contact the Property Manager for use of the Clubhouse for private events.    


PENALTY ASSESSMENTS

The Penalty Assessments listed below will apply to each and every violation of any and all of the Rules and Regulations stated above. 


PROCEDURE:

1.   First letter will be a Notice of the Violation

2.   Second Letter will be a $50.00 Penalty Assessment

3.   Third Letter will be a $150.00 Penalty Assessment.

4.   Continued violations will result in restriction of use of all common area facilities for a period to be determined by the Board of Directors. 

5.   NON-PAYMENT of any levied special assessment will result in legal action being taken for collection.

6.   Replacement of lost Pool key will be charged $100.  

7.   Exchange of defective or damaged Pool key $25.00   

*NOTICE TO ALL ESCROW AND REALTOR COMPANIES*

TUSTIN VILLAGE II HOMEOWNERS ASSOCIATION


REVIEW OF  REALTOR, SELLER AND BUYER RESPONSIBILITIES

Please advise the prospective new buyer AND seller of the following during escrow and at close of escrow:

1.   Electricity, Gas and Water for the unit is paid for by the homeowner. 

2.   The Association pays for the common area’s electricity, gas, trash pick-up and water only. 

3.   Vehicles:  A MAXIMUM of THREE (3) vehicles per unit is permitted in the complex. Any additional vehicles must be     

parked outside of the complex, on the street.   Only one vehicle with a sticker is permitted to be parked on the common streets at any given time.  NO Commercial Vehicles are allowed to be parked in the complex except for contractors performing resident services.  No overnight parking for commercial vehicles performing these services.   Parking Rules are strictly enforced, and violators will have their vehicle towed at their expense.

4.   Pools: Any children under the age of 14 years must be supervised by an adult when in the pools or pool areas. Entry and Exit must be with a pool gate key. Gate to be kept locked at all times. No pets are allowed in the pools or pool areas at any time.  Pool equipment is for Emergency use only - Do not remove.

5.   Patios: No structure can be built (either attached or not attached) or exterior of unit changed without submittal of drawings and approval of the Board. No clothes lines in the patio area.

6.   Front of Unit Plantings: This is a Common Area and maintained by the Association landscaper. No removal of existing plants and shrubs.  No planting by homeowner/resident is permitted. 

7.   Owners who have sold their property must return vehicle Parking Permit tags to the Security officer and advise of their departure date.  PARKING PERMITS ARE NOT TRANSFERABLE.   Thank you for your cooperation.
